HB410

AN ACT relating to risk protection orders.

Introduced·1/15/26
Bill Text

Establishes risk protection orders to prevent firearm possession by those deemed a risk to public health and safety.

This bill creates a process for risk protection orders in Kentucky to prevent individuals diagnosed with or treated for mental conditions that impair judgment from possessing firearms. A qualified mental health professional, peace officer, or other interested party can petition the court. If the court finds a risk to public health and safety, it can issue an order prohibiting firearm possession. The order is entered into the state's background check system and the state police database. Violation of the order is a Class A misdemeanor, and the firearm is subject to forfeiture.
