Kansas SB38 establishes conditions for deploying the Kansas National Guard into active duty combat.
Kansas SB38, known as the Defend the Guard Act, specifies that the Kansas National Guard cannot be deployed into active duty combat unless the U.S. Congress declares war or explicitly calls forth the Guard under the Constitution. This law emphasizes adherence to constitutional principles and the authority of the Kansas governor as commander in chief. The act defines "active duty combat" and "official declaration of war" for clarity.
