Kansas SB262 mandates government agencies and public utilities to make a good faith offer for property before filing an eminent domain action.

Kansas SB262 amends eminent domain procedures by requiring government agencies and public utilities to make a good faith offer for property before initiating eminent domain actions. If the offer exceeds the appraiser's award, the higher amount can be appealed by the property owner. The bill also prohibits the use of eminent domain for recreational trails and park and recreational facilities. Additionally, it eliminates the legislature's authority to condemn property for economic development purposes.
