Allows challenges to voluntary acknowledgments of paternity based on fraud, duress, or material mistake of fact.
This bill amends the acknowledgment of paternity process in Kansas. It allows individuals to challenge a voluntary acknowledgment of paternity if it was based on fraud, duress, or a material mistake of fact. Genetic test results that exclude the signatory father or identify another man as the father are considered a material mistake of fact. The bill also specifies that certain genetic testing results are considered a material mistake of fact. The acknowledgment of paternity creates a permanent father-child relationship without the requirement of further adjudication.
