Kansas HB2326 amends the state's sentencing guidelines to include consideration of whether the offender has physical custody of a minor child or is a legal guardian or custodian with physical custody of a minor child at the time of the alleged crime when determining whether to enter into a diversion agreement or to impose a departure sentence. This consideration is added to the existing factors that courts and county or district attorneys must weigh when deciding on diversions and dispositional departures.
