This bill requires insurers to negotiate in good faith all claims presented to health care providers. If a claimant offers to settle within the policy limits and the insurer refuses, the insurer is liable for the full judgment amount if the claim proceeds to judgment beyond the policy limit. The health care provider can also sue the insurer for failing to negotiate within the policy limits, recovering costs and reasonable attorney fees.
