SB0003

Constitutional amendment ballot language.

Complete·2/24/26

Proposed constitutional amendment to change bail eligibility for non-murder or treason offenses in Indiana.

This bill proposes a constitutional amendment to change the bail eligibility for individuals charged with offenses other than murder or treason in Indiana. Currently, such individuals are not entitled to bail if the proof is evident or the presumption strong. The amendment would require the state to prove by clear and convincing evidence that no release conditions will reasonably protect the safety of any other person or the community. This change would be submitted to the electors of Indiana at the 2026 general election.
