Indiana HB1415 limits nuisance actions against racetracks, protecting them from being deemed nuisances by those who bought or improved property after.

Indiana HB1415 amends the Indiana Code to limit nuisance actions against racetracks. It defines "area of the racing facility or racetrack" as within a five-mile radius of the property or contiguous group of properties operated as a racing facility or racetrack. The bill specifies that a racetrack or its appurtenances is not a nuisance if the action is brought by someone who purchased or improved property after the racetrack began operations. It also prohibits political subdivisions from restricting racetrack operations inconsistent with these provisions. Effective July 1, 2026.
