Indiana HB1390 amends the Indiana Code to require the Indiana Department of Transportation to make an original offer equal to 125% of the fair market value when purchasing property for a project. It also provides that a person having an interest in a property that is damaged as a result of a public use is entitled to bring an inverse condemnation claim. This change is effective July 1, 2026.
