Indiana HB1387 modifies the state's cemetery laws to allow the termination and resale of unused burial plots after 100 years. If a burial plot remains unused for at least 100 years and has no improvements, the cemetery can terminate the owner's rights. The cemetery must advertise in a local newspaper and on its website, if available, to notify the owner. If the owner does not respond within 60 days, the rights are terminated. The cemetery must also check for human remains before terminating rights if there is no record of usage. Any funds from the resale must be used to maintain the cemetery.
