Nondisclosure agreements in economic development.

Indiana HB1104 prohibits nondisclosure agreements in economic development contracts after June 30, 2026.

Indiana HB1104 amends the Indiana Code to prohibit the Indiana economic development corporation, the state, any state instrumentality, or any public authority from entering into economic development agreements or contracts that include nondisclosure provisions. This applies to agreements or contracts that provide economic development incentives such as tax incentives, tax abatements, grants, and more. The prohibition takes effect July 1, 2026.
