Civil liability for child sexual abuse material in Indiana.
The bill amends Indiana Code to establish civil liability for individuals who knowingly or intentionally allow or facilitate access to child sexual abuse material or obscene material on the Internet. It permits individuals depicted in such material or exposed to it to bring a civil action against the person responsible. If the individual is a child under 18, the child's parent or guardian may bring the action. Successful plaintiffs can recover actual damages, liquidated damages, punitive damages, injunctive relief, and court costs.
