SB4040 transfers charter school authorization from the State Board of Education to local boards for schools outside large cities, effective July 1.
SB4040 amends the Charter Schools Article of the School Code to transfer the authorization of any charter school located outside a district in a city with over 500,000 inhabitants to the local school board or boards on July 1, 2027. The State Board of Education will cease to be the authorizing body for these schools, transferring all powers, duties, contracts, and pending business to the local boards. Charter contract terms will remain in effect unless mutually amended, with a term of 7 years starting July 1, 2027.
