The Data Center Water Transparency and Aquifer Protection Act prohibits data centers in Illinois from using water from the Mahomet Aquifer starting January 1, 2027. It also bans state agencies from issuing or renewing permits for groundwater withdrawal from the Mahomet Aquifer by data centers. Existing data centers must cease groundwater withdrawals from the Mahomet Aquifer by January 1, 2028, and transition to alternative water sources. The Act mandates that local governments cannot enforce nondisclosure agreements that restrict the disclosure of data center water use information.
