Illinois SB3861 enhances penalties for fleeing or attempting to elude a peace officer.

Illinois SB3861 amends the Illinois Vehicle Code to increase the penalties for fleeing or attempting to elude a peace officer. It changes the offense from a Class A misdemeanor to a Class 4 felony for the first offense and from a Class 4 felony to a Class 3 felony for third or subsequent offenses. Additionally, it raises the penalty for aggravated fleeing or attempting to elude a peace officer from a Class 4 felony to a Class 3 felony for the first offense and from a Class 3 felony to a Class 2 felony for second or subsequent offenses.
