Illinois SB3578 prohibits foreign companies from constructing data centers unless a joint study certifies energy use does not affect PJM or MISO.

Illinois SB3578, known as the Data Center Construction by Foreign Adversaries Act, prohibits foreign companies from constructing data centers in the state. A foreign company is defined as one that is at least 51% owned by a foreign adversary or headquartered in a country with a government that is a foreign adversary. The prohibition can be lifted if the Illinois Commerce Commission, the Illinois Power Agency, and the Department of Commerce and Economic Opportunity conduct a joint study and certify that the energy used by the new data center is self-generated and does not affect the load.
