Illinois SB3458 creates the offense of unlawful restraint for civil immigration enforcement.

Illinois SB3458 amends the Criminal Code of 2012 to create the offense of unlawful restraint for civil immigration enforcement. This offense occurs when a person knowingly and without express legal authority from an immigration agent detains another for civil immigration enforcement purposes, uses force or threat of imminent force to transfer another person with intent to detain them, uses deceit or enticement to induce another person to transfer with intent to detain them, or uses a deadly weapon while detaining or transferring another person with intent to detain them.
