SB3438 amends the Illinois Administrative Procedure Act by modifying the second notice period for rulemaking. If the agency fails to provide a substantive response to a suggestion from the Joint Committee on Administrative Rules within 7 days of a statement of unresponsiveness, the second notice period is extended by up to an additional 45 days. A substantive response addresses the propriety, legal adequacy, statutory authority, economic effects, budgetary effects, or public policy of the rulemaking.
