Illinois SB3180 establishes the Artificial Intelligence Data Privacy Act, protecting user data from unauthorized AI training and disclosure.

Illinois SB3180, the Artificial Intelligence Data Privacy Act, mandates that deployers of artificial intelligence must not train AI on user data and retain it indefinitely without user consent. It also prohibits the disclosure of user data to third parties without express written consent. Users who suffer from violations can bring a civil action against the offending party, with potential damages and attorney's fees. The Act amends the Consumer Fraud and Deceptive Business Practices Act to include these violations as unlawful practices. Effective January 1, 2027.
