Illinois SB2393, known as the Prohibition of Nicotine Sales Near Schools Act, mandates that by January 1, 2026, every municipality and county must regulate the retail sale of nicotine-containing products within 1,000 feet of schools and day care centers. If a municipality or county fails to comply, the Department of Revenue is prohibited from issuing or renewing licenses for retailers or distributors of nicotine products within that area. Existing establishments can renew their licenses if the school principal or day care center owner does not object in writing.
