Illinois SB2393 prohibits nicotine sales near schools and day care centers.

Illinois SB2393, known as the Prohibition of Nicotine Sales Near Schools Act, mandates that by January 1, 2026, every municipality must regulate the retail sale of nicotine-containing products within its limits near schools and day care centers. Similarly, counties must regulate such sales outside municipal limits. If either fails to comply, the Department of Revenue is prohibited from granting licenses for nicotine sales within 1,000 feet of these facilities. The act also limits home rule powers to ensure consistent regulation.
