SB1723

EPA-SOLE-SOURCE AQUIFER

Complete·8/1/25

Prohibits carbon sequestration activities within a sole-source aquifer in Illinois.

This bill amends the Environmental Protection Act to prohibit carbon sequestration activities within a sequestration facility that overlies, underlies, or passes through a sole-source aquifer. The prohibition does not apply to activities permitted by the Environmental Protection Agency before the effective date of this Act or to Class VI wells with specific permit conditions. The bill also mandates that no person shall conduct a carbon sequestration activity without a permit from the Agency and an order for integration of pore space from the Department of Natural Resources, if applicable.
