SB1398

SB1398 amends the Illinois Solid Waste Management Act to establish a food and food scrap management hierarchy and related requirements for generators.

SB1398 amends the Illinois Solid Waste Management Act to establish a hierarchy for managing food and food scrap, prioritizing prevention, animal consumption, composting, and anaerobic digestion. It requires generators within 20 miles (25 miles after July 1, 2035) of a permitted composting facility or anaerobic digester to separate food and food scrap from other waste, arrange for its transfer to a facility managing it according to the hierarchy, or manage it on-site. The bill also mandates annual training for employees managing food and food scrap and sets penalties for violations.
