Illinois SB1184 ensures policemen denied reinstatement due to disability are presumed disabled for benefit purposes.

Illinois SB1184 amends the Illinois Pension Code to presume policemen applying for disability benefits and denied reinstatement by their employer due to physical or mental incapacity to be disabled. It mandates that no policeman meeting the requirements for a disability benefit can be denied unless offered reinstatement or a limited-duty position. The changes apply retroactively to January 1, 2023, entitling policemen denied benefits without such offers to retroactive disability benefits. The State Mandates Act is also amended to exempt this mandate from reimbursement requirements.
