Illinois HB5791 allows owner-occupied residential properties to include one accessory dwelling unit for a qualifying parent or spouse.

HB5791, known as the Family First Housing Act, permits owner-occupied residential properties to include one accessory dwelling unit for a qualifying parent or spouse. The unit can be attached or detached, located above a garage, but cannot be used as a short-term rental. Local governments can enforce building codes and safety requirements but cannot prohibit the unit's construction or occupancy. The Act takes effect on January 1, 2027.
