Illinois HB5749, also known as Trey's Law, declares nondisclosure clauses in settlement agreements void and unenforceable. These clauses, which prevent survivors of childhood sexual abuse from reporting or discussing their abuse, are deemed against public policy. The law applies to any settlement agreement entered into before, on, or after the effective date of this Act, covering offenses such as criminal sexual assault and aggravated criminal sexual assault. It does not prohibit confidentiality agreements on other settlement terms.
