DUI TREATMENT COURT ACT

Introduced·2/6/26
Introduced Text

Establishes DUI treatment courts in Illinois to reduce recidivism among DUI offenders.

The DUI Treatment Court Act creates DUI treatment courts in Illinois to address substance use disorders among DUI offenders. These courts follow problem-solving court principles and evidence-based practices. Judges must have training in criminal law, behavioral health, and substance use disorder. Participants must complete DUI risk education and may be required to undergo substance use disorder treatment. Courts can impose sanctions for non-compliance but cannot require participants to refrain from medication-assisted treatment. Certain violent offenders are excluded from participation.
