HB5179, known as the Protection of Neural Data Act, mandates that nonmedical entities using or facilitating neural devices must publicly post user agreements, privacy terms, and health and safety risks on their websites. It prohibits these entities from storing, retaining, or transferring neural data without explicit consent from the individual. If an individual retracts consent, the entity must delete all data within 30 days and instruct third parties to do the same.
