Illinois HB5016 amends the Unified Code of Corrections to restore general recidivism provisions. It specifies that a person convicted of a third Class X felony, criminal sexual assault, or first-degree murder, after two prior convictions, is deemed an habitual criminal. The bill also details conditions under which a third conviction for a Class 1 or Class 2 felony results in a Class X sentence. Notably, it excludes Class 1 or Class 2 felony convictions for theft from this sentencing provision.
