Establishes a process for tenants in common to obtain legal title to inherited real property.
The bill amends the Code of Civil Procedure to allow tenants in common who have inherited real property under the intestate provisions of the Probate Act of 1975 to seek legal title to the property. To do so, the tenants in common must have held exclusive possession of the property for 7 years, paid all taxes, and contributed to the care, maintenance, or improvement of the property. They must also file a declaration with the recorder of deeds at least 2 years before commencing an action, notify other owners by mail or text, and publish a notice in a local newspaper.
