From the Legislature

Amends the Criminal Code of 2012. Provides that an action for recovering illegal gambling losses from the winner may be instituted if the person's gambling losses amounted to the sum of $5,000 (rather than $50) or more. Deletes a provision that if within 6 months, such person who under the terms of the provision is entitled to initiate action to recover his or her losses does not in fact pursue his or her remedy, any person may initiate a civil action against the winner. Deletes that the court or the jury, as the case may be, shall determine the amount of the loss and after such determination, the court shall enter a judgment of triple the amount so determined. Provides that losses as a result of participation in any fantasy contests against a fantasy contest operator, including single-player fantasy contests, are not recoverable under the provision. Provides that the provisions of the amendatory Act are declarative of existing law. Effective immediately.
