Illinois HB4845 creates a process for releasing health care records of incapacitated persons.

Illinois HB4845 amends the Code of Civil Procedure to establish a procedure for releasing the health care records of incapacitated persons. The bill specifies that such records must be released upon written request from the incapacitated person's guardian or an agent appointed under a power of attorney for health care. If no guardian or agent exists and the incapacitated person did not object in writing, the records can be released to a spouse, adult child, parent, or adult sibling.
