HB4839

NO FETAL DEATH CERTIFICATE

Chamber Passed·4/9/26

Illinois HB4839 eliminates the requirement for a fetal death certificate for fetal deaths under 20 weeks or abortions.

Illinois HB4839 amends the Vital Records Act to remove the need for a fetal death certificate for fetal deaths occurring after less than 20 weeks of gestation or in cases of abortion. The Department of Public Health will create a form for funeral directors to use to obtain a permit for burial, entombment, or cremation. The bill also modifies the Hospital Licensing Act to require hospitals to notify patients of their options for fetal remains disposition. The funeral director must file a written report within 24 hours of taking custody of the remains.
