Illinois HB4837 amends the Code of Civil Procedure to change the parties involved in a foreclosure action. It specifies that only the mortgagor and other persons owing payment or obligations secured by the mortgage, excluding guarantors, are necessary parties. The court may proceed to adjudicate their interests, but any disposition of the mortgaged real estate is subject to the interests of other persons not made a party. The bill also allows for the joining of other parties, including possessory interest holders, spouses, trustees, note holders, guarantors, and the State of Illinois.
