Illinois HB4722 allows circuit court clerks to establish a will depository for safekeeping of original wills.

Illinois HB4722 amends the Clerks of Courts Act to authorize circuit court clerks to establish and maintain a will depository. This facility allows for the voluntary safekeeping of original wills before the death of the depositor. A depositor can deposit a will if they certify in writing that they are unable to locate the testator after a diligent search. The clerk must provide a receipt, seal the will in an envelope, and index it alphabetically. The clerk may charge a fee of $25 per will deposited, but not for additional documents related to the same testator.
