The bill amends the Wrongful Tree Cutting Act to allow neighboring parcel owners to remove trees encroaching on their farmland if the Illinois Department of Transportation does not remove the tree within 60 days of a request. The neighboring parcel owner can remove the tree at their own expense without compensating the Department of Transportation. The Department of Transportation can delay removal for an additional 60 days if they cannot act in good faith within the initial 60 days. The parcel owner is immune from claims of damages, except in cases of gross negligence or willful misconduct.
