Illinois HB4401 creates the offense of criminal firearm negligence for failing to securely store a firearm accessible to prohibited persons.

Illinois HB4401 amends the Criminal Code of 2012 by adding a new section defining the offense of criminal firearm negligence. This offense occurs when an individual owns, possesses, or controls a firearm, knows or reasonably should know that a prohibited person resides in or regularly accesses the premises, fails to securely store the firearm as required by law, and the prohibited person gains access to the firearm.
