HB4231

Illinois HB4231 allows candidates to recover attorney's fees and costs from objectors if the electoral board deems an objection frivolous.

Illinois HB4231 amends the Election Code to allow candidates to petition the circuit court for reasonable attorney's fees and costs from objectors if the electoral board finds an objection to be frivolous. The electoral board must state its findings in writing and notify all parties involved. If a party fails to appear for the decision, the decision is deemed served. The bill also outlines procedures for the electoral board to follow when handling objections, including the power to subpoena witnesses and administer oaths.
