HB3638 amends the Workplace Transparency Act to ensure employees, prospective employees, and former employees cannot be restricted from reporting unlawful conduct or participating in legal proceedings related to employment disputes. It voids any contract terms that prevent employees from reporting allegations of unlawful conduct to government agencies, participating in legal proceedings, making truthful statements, or engaging in concerted activities. Confidentiality agreements in settlement or termination contracts are limited to five years post-incident and must be mutually agreed upon.
