Illinois HB3631 allows the Capital Development Board to directly pay subcontractors if prime contractors fail to pay within 30 days.

Illinois HB3631 amends the Capital Development Board Act and the State Prompt Payment Act to allow the Capital Development Board to issue direct payments to subcontractors on State-funded projects. This applies if the subcontractor submits an affidavit and supporting documentation verifying the amount due, the prime contractor fails to pay within 30 days of receiving payment from the Board, and the subcontractor provides written notice of non-payment to both the Board and the prime contractor. The Board must notify the prime contractor and allow a 10-day response period.
