Illinois HB3590 allows the use of open space for temporary stormwater storage without changing the land use designation.

Illinois HB3590 amends the Illinois Municipal Code and the Open Space Lands Acquisition and Development Act to allow the use of open space for temporary stormwater storage. This means that detention basins or other systems designed to temporarily collect, hold, and remove stormwater runoff can be used without altering the land use classification. Additionally, this use does not interfere with the requirement that the property must remain open to the public for recreation.
