HB3359

PEREMPTORY CHALLENGES-JURORS

Complete·8/15/25

Illinois HB3359 amends jury selection procedures, increasing the number of jurors and allowing more alternate jurors.

Illinois HB3359 modifies jury selection procedures by increasing the number of petit jurors that can be drawn to serve from 14 to 16 if alternate jurors are required. It also allows the court to impanel up to 4 alternate jurors instead of 1 or 2. Each side in a trial is entitled to 5 peremptory challenges, with additional challenges allowed for each additional party on the side with the most parties. If parties cannot agree on the allocation of peremptory challenges, the court will determine it. The changes apply to actions commenced or pending on or after January 1, 2026.
