HB3138, the Temporary Immunity for Child Welfare Agencies Act, provides a two-year immunity from civil liability for licensed child welfare agencies in Illinois, except when their actions or omissions constitute willful and wanton conduct. The Act also establishes the Child Welfare Agency Liability Task Force to evaluate and recommend solutions for the unavailability of liability insurance for child welfare agencies. The Task Force is required to submit its first report to the General Assembly by December 31, 2026.
