Illinois HB3002 allows courts to seal court files in marriage dissolution cases if they lack factual or legal basis.

Illinois HB3002 amends the Illinois Marriage and Dissolution of Marriage Act by adding a provision that allows courts to seal court files, including pleadings, if they find the actions or portions of the file lack a basis in fact or law. This may include cases where there is a lack of jurisdiction or where sealing is in the interests of justice. The sealing cannot pertain to whether any order of protection has been entered. The Act also ensures that sealing does not interfere with child support payments, income withholding for support, or reporting of support orders.
