Illinois HB2479 amends the Illinois Pension Code to presume disability for policemen denied reinstatement due to incapacity and allows prevailing.

Illinois HB2479 amends the Illinois Pension Code to presume disability for policemen who apply for disability benefits and are denied reinstatement by their employer due to physical or mental incapacity. It also allows policemen who prevail in administrative review actions challenging the denial or termination of disability benefits to recover court costs and litigation expenses, including reasonable attorney's fees. The bill further amends the State Mandates Act to exempt the implementation of this amendatory Act from any reimbursement requirement.
