HB2454 amends the Local Governmental and Governmental Employees Tort Immunity Act to redefine public entity liability for unsafe conditions on roadways. It specifies that a person operating a bicycle is deemed an intended user of roadways where bicyclists are permitted. The bill exempts public entities from liability if they did not have constructive notice of unsafe conditions that were not reasonably safe, either because such conditions would not have been discovered by civil law or because the entity maintained an inspection system with due care and did not discover the condition.
