HB2435

TELE SOLICITATION-AUTO DIALER

Chamber Passed·4/9/25

Illinois HB2435 amends the Telephone Solicitations Act to restrict automatic dialing and auto dialers for sales solicitations.

Illinois HB2435 amends the Telephone Solicitations Act by prohibiting the use of automatic dialing, auto dialers, or computer programs mimicking human operators for sales solicitations, except with prior consent. It also mandates that live operators disclose their name and the business name, ask for consent, and remove the caller from the list if requested. The act allows customers to sue for damages of $500 per violation, plus costs and attorney's fees. Exemptions include emergency calls, government entities, and calls made by registered dealers or investment advisers.
