Illinois HB1467 amends the Criminal Code of 2012 by removing the affirmative defense for patronizing a minor engaged in prostitution. This means that individuals who engage in sexual acts with a minor or a person with a severe or profound intellectual disability will no longer be able to claim they reasonably believed the person was over 18 or not intellectually disabled. The bill retains the penalties for such acts, including a Class 3 felony for patronizing a minor and a Class 2 felony if committed within 1,000 feet of a school.
