Illinois HB1309 amends the Workers' Compensation Act to establish rebuttable presumptions for certain health conditions of firefighters, EMTs, and paramedics. Specifically, it presumes that certain conditions, including lung or respiratory disease, heart or vascular disease, hypertension, tuberculosis, or cancer, arise out of and in the course of employment. This presumption shifts the burden of proof to the employer, who must provide clear and convincing evidence of an independent, non-work-related cause.
