HB1165 amends the School Code to allow school districts to classify funds received from certain state aid programs as funds for special education residential facilities. School districts must offer parents the option to place their child in a comparable in-state facility. The bill also allows districts to place students in nonpublic day or residential special education facilities that meet certain criteria. The State Board of Education must establish rules for determining when private facility placement is appropriate and review placements annually.
