Illinois HB1058 amends the Prevailing Wage Act to enhance penalties for contractors and subcontractors who fail to pay the prevailing wage rate.

HB1058 amends the Prevailing Wage Act to increase penalties for contractors and subcontractors found liable for underpaying laborers, workers, or mechanics. Contractors or subcontractors found liable for underpayments in a second or subsequent action must pay 50% of the underpayments to the Department of Labor and an additional 5% to the state. They are also liable for punitive damages of 2% of the underpayments for each month the underpayments remain unpaid. The Department of Labor can take wage claims in trust for laborers, workers, or mechanics and bring legal action to collect the claims.
